Ms. Hascup’s client, a doctor, was charged by the Newark Police Department with Simple Assault, a disorderly persons offense, following an alleged domestic violence incident with his ex-girlfriend. Due to the nature of the charge, her client was facing a maximum of six months in jail and a $1,000 fine.
Interestingly, her client was charged in January 2013 (following his break-up with the ex-girlfriend) with an offense that allegedly occurred in September 2012. The timing alone was suspect.
As a good faith gesture, Ms. Hascup’s client willingly engaged in therapy, designed to assist him in productively dealing with emotional issues that arise during the course of relationships.
After multiple court appearances, during which the State could not produce more than an outstanding bill which showed that the ex-girlfriend had apparently gone to a local hospital at some point in September 2012, and taking into account the client’s good character, complete lack of criminal history, and willingness to engage in therapy, the charge was dismissed.
It was a great result.
