Ignition Interlock Devices: The Law in New Jersey
On December 1, 2019, the DWI laws in New Jersey changed. ALL individuals convicted of DWI (first, second, and third offenses, notwithstanding your blood alcohol content) are now required to install an ignition interlock device . An ignition interlock device is a blowing device that tests the driver’s blood alcohol content. It disables the ignition of an automobile until the driver blows a clean breath test sample into the device.
First, Second, and Third Offenses: The new DWI statute now requires that a first-time DWI offender pay for the installation and maintenance of the ignition interlock device for a period of between three (3) months and fifteen (15) months (depending on their blood alcohol content). Second and third-time DWI offenders are required to install and maintain the device for the period of their license suspension and for a period of two (2) to four (4) years following the return of their driver’s license.
