What is an Indictment?
An Indictment is a formal charging document. It gives criminal defendants basic information to inform them of the charges that have been filed against them, including but not limited to the date and location of the crime(s) alleged, and what is alleged to have been done (i.e., the conduct) that gives rise to each charge. Indictments will also list the statute that the defendant is alleged to have violated and (often times) the degree of each charge.
In NJ, an Indictment can only be issued by a Grand Jury after it has considered the evidence presented by the State.
Once an Indictment has issued against a criminal defendant, he/she will be noticed to appear for an Arraignment before a Superior Court Judge and will start the process towards trial.
