A Teaneck man was arrested on Monday morning after Wayne Police received a call that an alarm was going off at the STS Tire store on Hamburg turnpike. Officers arrived at the automotive supply store shortly before 6:30am where they found a running vehicle with an open door. After entering the building, police allegedly found 30 year-old Camden Yearwood still inside. He was arrested and charged with one count of burglary, two counts of motor vehicle burglary and two counts of theft. Additionally, he was charged with: possession of a controlled dangerous substance and possession of paraphernalia. The state of New Jersey takes burglary charges seriously. Burglary is codified under N.J.S.A. 2C:18-2, which provides:
a. A person is guilty of burglary if, with purpose to commit an offense therein or thereon he:
1. Enters a research facility, structure, or a separately secured or occupied portion thereof unless the structure was at the time open to the public or the actor was licensed or privileged to enter;
2. Surreptitiously remains in a research facility, structure, or a separately secured or occupied portion thereof knowing that he is not licensed or privileged to do so; or
3. Trespasses in or upon utility company property where public notice prohibiting trespass is given by conspicuous posting, or fencing or other enclosure manifestly designed to exclude intruders.
Burglary in the third degree is punishable by a term of imprisonment of up to 5 years in New Jersey State Prison.
A crime of the second degree is punishable by a term of imprisonment of between 5 and 10 years in New Jersey State Prison. Burglary in the second degree is an enumerated crime under the No Early Release Act (NERA), meaning that 85% of the sentence imposed must be served before becoming eligible for parole.
