Wayne Teenager Sexually Assaulted In His Home

Wayne Police are looking for a man who kissed and assaulted a 15 year old Wayne boy. The 15 year old was home alone and heard a knock on the door. He went to the door and was immediately confronted aby the man who pushed his way in and kissed the boy while also trying to take his clothes off. Captain Mark McGrath said the incident occurred off Valley Road and Berdan Avenue. The boy was able to fight the man off of him and the man then fled from the home in a large Chevy Silverado pickup. The man was around 40 to 50 years of age and tall. Assault and Burglary are very serious offenses and when a juvenile is involved the charges are more severe. The Wayne Police Department is still looking for this man.

Under N.J.S.A. 2C:14-3 which is criminal sexual contact. It involves touching or kissing inappropriately. It also involves Megan’s Law registration, and life time community supervision when there is a juvenile involved whose under the age of 16. It is a crime of the 4th degree and is punishable by up to 18 months in New Jersey State Prison.

Under N.J.S.A. 2C:18-2 which is burglary, is the act of entering a building without consent to enter the home. When an assault also occurs the charges are upgraded to a crime of the 2nd degree. A crime of the 2nd degree is punishable by 5 to 10 years in New Jersey State Prison. Burglary also is included under NERA. Burglary in the second degree is an enumerated crime under the No Early Release Act ( NERA ), meaning that 85% of the sentence imposed must be served before becoming eligible for parole.
