A 10 year old girl was sexually assaulted three separate times, once by a 54 year old man, Vicente Cunalata of Moonachie, also by Luis Solano a 40 year old man from Hackensack, and lastly by a 15 year old boy. The young girl had told her mother, who then contacted Hackensack Police as well as The Bergen County Prosecutors Office Special Victims Unit. Vicente Cunalata was charged with aggravated sexual contact, sexual assault by sexual contact, and endangering the welfare of a child. The 15 year old was charged with aggravated sexual contact, sexual assault by contact, and endangering the welfare of a child. Luis Solano is still not apprehended and police are charging him with the same offenses.
Under N.J.S.A. 2C:14-2a which is aggravated sexual assault, it is a crime of the 1st degree. For which a person is looking at prison sentence of up to 10 to 20 years if found guilty. Aggravated sexual assault is a serious offense and due to N.E.R.A. 85% of the sentence must be served before the possibility of parole.
Under N.J.S.A. 2C:14-2b and N.J.S.A. 2C:14-2c which is sexual assault by sexual contact it is a crime of the 2nd degree and a person is looking at 5 to 10 years in prison if found guilty. Also due to N.E.R.A. a person must complete 85% of their sentence before becoming eligible for parole.
Under N.J.S.A. 2C:24-4 which is endangering the welfare of a child, and if the person has a legal duty for the child and sexually assaults them, it is a crime of 2nd degree, and a prison sentence of 5 to 10 years if found guilty. If it is any other person who is with the child it is a crime of the 3rd degree.
