Registered Sex Offender Accused of Multiple Sex Crimes

In a recent indictment against a registered sex offender from Bernards Township, the man is charged with endangering the welfare of a child, aggravated criminal sexual contact, andattempted sexual assault for alleged offenses committed in both Somerset and Essex Counties.

37-year-old Damien Moye, who accepted a guilty plea for endangering the welfare of a child charges in 2008 in Middlesex County, is accused of having criminal sexual contact with a 14-year-old girl as well as attempting to sexually assault her. The offenses allegedly began in 2011 between September 1st and December 20thand continued for almost two years at various sites located in Newark and Somerset County.

According to court documents, an employee at the Bernards Township High School notified the Bernards Township Police Department of the alleged crimes after being informed by the victim, who claims that Moye first violated her when she was just 12 years old.

The affidavit filed against Moye identifies him as a registered sex offender, which is governed under Megan’s Law and guarantees community supervision for life. His prior status as a sex offender will undoubtedly affect his sentencing if Moye is convicted of the most recent charges against him.

According to guidelines set forth in the New Jersey Criminal Code pertaining to sexual offenses, convictions for certain second or subsequent sexual offenses include a mandatory minimum term of imprisonment. Sentencing for a second or subsequent sexual offense conviction is codified under N.J.S.A. 2C:14-6, which sets forth that:

If a person is convicted of a second or subsequent offense under N.J.S.A. 2C:14-2 (Sexual Assault) or N.J.S.A. 2C:14-3a (Aggravated Criminal Sexual Contact), the sentence shall include a fixed minimum sentence of not less than 5 years during which the defendant shall not be eligible for parole.

Moye is currently serving time in New Jersey State Prison for violating the terms of his parole, after being sentenced to a 14-month term of incarceration in August.
