Paterson Police Narcotics Detectives took a pound of marijuana from a 27 year old city man who was arrested on drug dealing charges. Darryl Smoot was arrested on Carlisle Avenue which is by Garret Mountain. The police were led to the area after residents in the area noticed that there was drug dealing near a grocery store in the neighborhood. Darryl Smoot who lives in the Hillcrest section of the city was charged with possession of marijuana, intent to distribute near a school, and intent to distribute according to Police Director Jerry Speziale. Police also took $495 in proceeds from him as well which they seized along with the drugs. Being charged with possession of marijuana in this amount is very serious as well as selling drugs on or near school property.
Under N.J.S.A. 2C:35-10a(3) which is possession of 50 grams or more of marijuana. It is the act of having on ones person 50 grams or more of marijuana or hashish. It is a crime of the 4th degree. A person found guilty of a crime of the 4th degre is looking at up to 18 months in New Jersey State Prison. There may also be a fine of $25,000 as well.

It is the act of distributing drugs or possesing drugs with the intent to distribute them within 1,000 feet of a school or a school bus. Being charged with this act is a crime of the 3rd degree in New Jersey. A person found guilty of a crime of the 3rd degree is looking at 3 to 5 years in New Jersey State Prison.
