A Bergenfield doctor Raja Jagtiani has been arrested again on four charges of criminal sexual contact, and harassment by offensive touching of women. Dr. Jagtiani who lives in Dumont was charged on September 23rd with new charges. He was originally arrested on August 25th after The Bergen County Prosecutors Office conducted an investigation and charged him then. Three more woman have now come forward and said that they also were victims of sexual contact and harassment by the doctor. Raja Jagtiani was able to post $50,000 bail and was released, A new court date of Oct 7th has been scheduled for municipal court.
Under N.J.S.A. 2C:14-3b which is criminal sexual contact. It involves the use of force, coercion into any type of sexual touching of the victim and also the defendant being sexual with themselves. The act must be done under the law with a purpose to degrade, or humiliate the victim and also arouse the defendant. It is a crime of the 4th degree in New Jersey. If found guilty of a crime of the 4th degree a defendant will be looking at up to 18 months in New Jersey State Prison.
Under N.J.S.A. 2C:33-4b which is harassment. It involves becoming bothersome and engaging in unwanted attention from another person, it involves hitting, kicking, offensive touching etc. Constant communication with the victim at odd hours, offense language, or an annoyance that causes one to be alarmed also are under this statute. It is a petty disorderly persons offense which is punishable by up to 3 months in the county jail, but it becomes a crime of the 4th degree if the defendant was in jail or on parole or probation, from any other indictable offenses in New Jersey, other States, or the Country.
