After being convicted on charges of carjacking, robbery, criminal restraint, and aggravated criminal sexual contact in April, a Newark man was recently sentenced to a 40-year term of incarceration in Essex County Superior Court.
This sentence stems from charges brought against 24-year-old Newark resident Isaiah L. Greene in connection with an incident that occurred in South Orange in 2011. According to prosecutors, Greene carjacked and sexually assaulted a 21-year-old female victim from Orange, New Jersey, at a train station on December 10, 2011 at approximately 2 p.m.
After threatening the woman with a gun and stealing her money as well as her phone, Greene entered the vehicle with the victim, forcing her to drive as he sexually assaulted her. In about two miles, the woman noticed a marked sheriff’s vehicle as she was driving past Vailsburg Park in Newark, at which time she drove her car into the police car and fled.
Although Greene fled the scene as well, he was tracked down and taken into custody later that day. Following his arrest and the filing of the charges, Greene was detained for 776 says, which will contribute toward his sentence as time-served.
According to the Essex County Prosecutor’s Office, Assistant Prosecutor Brian Matthews had requested that Greene be sentenced to 50 years following his conviction. Greene’s extensive prior criminal record, both as a juvenile and as an adult, was cited as an aggravating factor in support of this recommendation.
In terms of the potential penalties associated with the charges for which he was found guilty,carjacking, which is governed under N.J.S.A. 2C:15-2, is considered a crime of the first degree, punishable by an extended term of incarceration ranging from 10 to 30 years in New Jersey State Prison. Robbery, codified under N.J.S.A. 2C:15-1, is also a first degree offense, punishable by a sentence of 10 to 20 years in prison. Further, carjacking and robbery are both offenses enumerated under the No Early Release Act (“NERA”), which requires those convicted to serve 85 percent of the sentence imposed before becoming eligible for parole.
Ultimately, Essex County Superior Court Judge Michael Ravin sentenced Greene on Friday, January 24th to a 40-year term in New Jersey State Prison, 32 years of which must be served before he becomes eligible for parole.
