According to police in Paterson, a city man is being accused of committing numerous burglaries in the area. According to Passaic County Sheriff, Richard Berdnik, 40 year-old Jose L. Rosario allegedly burglarized a parked vehicle on Market Street at around 1:00am by smashing the front passenger side window with a brick. He stole a purse containing a wallet, several other credit cards and personal documents belonging to the victim. Detectives from the Passaic County Sheriff’s Office Criminal Investigation Division (CID) obtained video footage of the incident from nearby business. The suspect is allegedly seen on video smashing the car window, grabbing an item and hiding it under his coat. On April 19, 2019, police received report of a second vehicle burglary on Grand and Marshall Streets at 1:15am – the vehicle’s side window was smashed and multiple items were missing from the car.
When Police ultimately caught up with Rosiario, he admitted to committing both of the vehicle burglaries. He was subsequently charged with burglary, theft, and criminal mischief in both incidents. Click here to read more at www.patersontimes.com.
Burglary is a crime of the third degree, except that it is a crime of the second degree if in the course of committing the offense the actor: 1. Purposely, knowingly or recklessly inflicts, attempts to inflict or threatens to inflict bodily injury on anyone; or 2. Is armed with or displays what appear to be explosives or a deadly weapon. A crime of the third degree is punishable by a term of imprisonment of up to 5 years in New Jersey State Prison.
A crime of the second degree is punishable by a term of imprisonment of between 5 and 10 years in New Jersey State Prison. Burglary in the second degree is an enumerated crime under the No Early Release Act (NERA), meaning that 85% of the sentence imposed must be served before becoming eligible for parole.
