156 Bags of heroin, and Gun Seized in Hamilton Street Raid in Paterson

According to police director, Jerry Speziale, Paterson Police arrested two people during a raid at 356 Hamilton Avenue on Wednesday. According to police, 156 glassine bags of heroin were seized along with 1 knotted bag of heroin and 1 bag of crack cocaine. During the raid, police also seized a Jimenez Arms handgun Model J.A. Nine 9mm and eight hollow point bullets. 22 year-old Matthew Clancy of Paterson and 44 year-old Samantha Humienny of Wellington, Florida were arrested. Heroin is a Schedule I narcotic. Under N.J.S.A. 2C:35-10, possession of a Schedule I narcotic is considered a Third degree crime which is punishable by a term of incarceration between 3 and 5 years in New Jersey State Prison. A fine of up to $35,000.00 may be imposed. 

N.J.S.A. 2C:35-5 sets forth: a. Except as authorized by P.L.1970, c.226 (C.24:21-1), it shall be unlawful for any person knowingly or purposely: (1) To manufacture, distribute or dispense, or to possess or have under his control with intent to manufacture, distribute or dispense, a controlled dangerous substance or controlled substance analog; or (2) To create, distribute, or possess or have under his control with intent to distribute, a counterfeit controlled dangerous substance. A crime of the Third Degree a crime of the Third Degreeis punishable by a term of incarceration between 3 and 5 years in New Jersey State Prisonexcept that a fine of up to $75,000.00 may be imposed.

Any person who has in his possession any firearm while in the course of committing, attempting to commit, or conspiring to commit a violation of N.J.S.2C:35-3, N.J.S.2C:35-4, N.J.S.2C:35-5, section 3 or section 5 of P.L.1997, C. 194 (C.2C:35-5.2 or 2C:35-5.3), N.J.S.2C:35-6, section 1 of P.L.1987, c.101 (C.2C:35-7), section 1 of P.L.1997, c.327 (C.2C:35-7.1), N.J.S.2C:35-11, or N.J.S.2C:16-1 is guilty of a crime of the second degree which is punishable by a term of incarceration between 5 and 10 years in New Jersey State Prison.
