Two men from Paterson who are accused of providing heroin to an Allendale resident that overdosed will be going to trial in March. Senior Assistant Prosecutor Danielle Grootenboer said to Bergen Superior Court Judge Susan H. Steele that there was a change in events and that the two men Timothy Volpe and Kaleik Easton both 21 year old men were not interested in pleading. The state is no longer negotiating a plea with anybody Danielle Grootenboer said to Judge Susan H. Steele. The two men were originally going to be charged with a more serious crime but the attorneys in both parties decided on a 6 year plea deal. The men are charged with strict liability and other charged as well.
Under N.J.S.A. 2C:35-9 which is Strict Liabilty. It involves a person selling, any type of class I or II drugs to a person who dies from the use of those drugs. It is a crime of the first degree for causing another persons death as a result of selling them drugs. A person found guilty of a crime of the 1st degree is looking at 10 to 20 years in New Jersey State Prison.
