Saddle River Police Department have acknowledged that a burglar attempted to enter a home on Fox Hedge Road this past Saturday. The attempted break in happened after 8:30 pm when the homeowners were not home, as the back door was pried open the alarm switched on and the attempted burglar fled. The rear door s alarm sent the burglar running, and as police officers arrived to the home, they saw that the burglar had fled. Bergen County Sheriff s Officers as well as police from surrounding towns saw that the burglar was not in the area. Police did note that nothing was taken from the home. Saddle River Police Chief Timothy McWilliams said that burglaries start to become more common this time of year and that lights on in the home, and flood lights on the outside of the home help to thwart these type of occurrences. Chief McWilliams also said to call us immediately if you see any suspicious activity.
Under N.J.S.A. 2C:18-2 which is Burglary. Burglary is the attempt and completed attempt to enter a home or building that a person is not authorized to enter. Burglary is on a graded scale, and the charges can be anywhere from 2nd to 3rd degree. For burglary to be a crime of the 2nd degree, the defendant must purposefully, and knowingly inflict, or attempt to inflict bodily injury to anyone. Also having what appears to be explosives or a deadly weapon while in the attempt of a burglary will make it a crime of the 2nd degree as well. It becomes a crime of the 3rd degree when a person enters a home or building or attempts to enter that home. A person found guilty of a crime of the 2nd degree is punishable by 5 to 10 years in New Jersey State Prison, and they will also be under NERA. A person found guilty of a crime of the 3rd degree will be looking at 3 to 5 years in New Jersey State Prison.
