On Monday in Paterson, 16 year old Javier Burgos was killed in a hit and run on the corner of Oak and Beech Street. The suspect was at large until Paterson Police and the Prosecutors Office both investigated and located the suspect James Reinhardt a 34 year old man and arrested him Wednesday. James Reinhardt was driving a 2006 VW Jetta Monday night when he hit and killed Javier. Reinhardt is a Paterson resident and has been charged with leaving the scene of a fatal motor vehicle accident, endangering an injured victim, and causing death while driving on a suspended license. If Mr. Reinhardt is found guilty on all charges the prison sentence can be up to 20 years in state prison.
Under N.J.S.A 39:4-129 which is leaving the scene of an accident, there is a mandatory loss of license for one year. There can also be fines and jail.
N.J.S.A. 2C:12-1.2 is Endangering an injured victim which is a crime of the 3rd degree, it involves leaving a victim with bodily injuries and leaves them at the scene of the accident. It is a very serious crime. It is a crime of the 3rd degree and is punishable by 3 to 5 years in New Jersey State Prison.
N.J.S.A. 39:3-40(e) is Driving While Suspended and includes causing death while doing so. It is a crime of the 3rd degree and if found guilty a person is looking at 3 to 5 years in New Jersey State Prison. In addition the person is looking at losing their license for a period of one year.
